Introduction

Welcome to Valour Health Clinic.

Before proceeding, please take a moment to read the following Terms and Conditions carefully. This document outlines important information regarding your care, your rights and responsibilities, and how we manage your personal and health information.

By continuing, you acknowledge that you understand and accept these terms, including the use of unapproved therapeutic goods (UTGs), the potential risks and benefits of such treatments, and our clinic’s obligations under Australian privacy and health legislation.

Benefits, Risks and Potential Complications for Unapproved Therapeutic Goods

Our doctors may prescribe unapproved therapeutic goods (“UTG”). These are goods which are not registered on the Australian Register of Therapeutic Goods. UTG have not been assessed for quality, safety and efficacy by the Therapeutics Goods Administration. Access to UTG are provided through a Special Access Scheme or Authorised Prescriber Scheme. There are risks associated with UTG. The benefits and potential harms of UTG use by children, in pregnancy or while breast-feeding are not well understood. There may be associated side effects from the use of UTG or adverse interactions between UTG and other medications you are taking.

Medicinal cannabis (“MC”) is an UTG. Possible known side effects from MC, specifically with any MC product containing Tetrahydrocannabinol (“THC”), may include: nausea, light-headedness, uncontrolled laughter or euphoria, dry mouth, increased appetite, vomiting, relaxation, sedation, drowsiness, abnormal blood pressure, abnormal physical weakness or lack of energy, confusion, disorientation, dizziness, vertigo, balance and coordination problems, bowel changes, memory changes, cognitive impairment, hallucinations, anxiety, paranoid thoughts, psychosis, mental disturbance, abnormal heart rate, lethargy, seizures, and chronic bronchitis (if inhaled). These potential side effects are not an exhaustive list and there may be unknown side effects associated with MC.

MC products may contain various concentrations of THC. MC products which predominantly contain cannabidiol (“CBD product”) may still contain trace amounts of THC. If you are prescribed a MC product as part of your treatment, including a CBD product, you acknowledge that THC may appear in your blood, saliva and other samples. Depending on the State you live in, zero-tolerance laws for driving with detectable THC may apply, and a legally issued prescription may not provide a defence to such an offence.

You release Valour Health Clinic and its related bodies corporate from any liability arising in connection with any recommended treatment and any potential side effects or adverse effects that may arise in connection with the use of any UTG.

Partner Pharmacies  

If a treatment is deemed appropriate for you by our doctors, then any medications prescribed to you by our doctors (“Prescribed Medication”) may be dispensed by our partner pharmacies. We select our partner pharmacies based on their experience dispensing medication, their stock availability and quality of care. We recommend you use our partner pharmacies to dispense your Prescribed Medication, however, you have the right to have your Prescribed Medication dispensed at any pharmacy of your choice. Please let our team know if you would like your Prescribed Medication to be dispensed by a different pharmacy.

Storage of Prescribed Medication

At all times, your Prescribed Medication should remain in its original container displaying the pharmacy label with your prescription details.

Management of Health and Medical Information

As part of the provision of our services, we need to collect and record personal information from you, such as your name, contact information, medical history and other relevant information. This collection of personal information will be a necessary part of the services that are provided in accordance with our privacy policy accessible at [PRIVACY POLICY HYPERLINK] (“Privacy Policy”).

To enable us to provide services to you and to ensure compliance with the Privacy Act 1988 (Cth), the following Australian Privacy Principles and Health Privacy Principles apply:

1. Personal information will only be used for the purposes for which it was collected or as otherwise permitted by law, and we respect your rights to determine how personal information is used or disclosed.
2. Your personal information may be collected by a number of different methods, including from medical test results, notes from consultations, recording your Medicare details, data collected from observations and conversations with you, and information obtained from other health care providers.
3. At all times we are required to ensure your personal information is treated with the utmost confidentiality. Your records are very important, and we will take all steps necessary to ensure they remain confidential.

We will also deal with your personal information and health records in compliance (where applicable) with the Privacy and Data Protection Act 2014 (VIC) and the Health Records Act 2001 (VIC):

Sharing Information

In order for our doctors to consult with you regarding your potential or actual treatment, we will need to share your personal information with those doctors. To enable the provision of our services, we may also need to share your personal information (including health information) with our related bodies corporate, Partner Pharmacies and any other third parties, including our employees, officers, insurers, professional advisers, agents, suppliers or contractors. All information will be shared in accordance with our Privacy Policy and all applicable privacy laws.

In some circumstances, we are legally obliged to disclose information about you, such as if your records are subpoenaed for a court case or where legal requirements to collect information about particular health conditions applies, such as in the case of life-threatening diseases or diseases with high public health risks. We will ensure that any such disclosure is limited to only what is required by law.

Patient Behaviour

You must treat Valour Health Clinic doctors and staff members with respect and professionalism at all times. Valour Health Clinic may at its sole election cease providing services to you if your behaviour does not meet this standard.

Valour Health Clinic may at its sole election cease providing services to any patients found to be misusing Prescribed Medications.

Terms of Service

Valour Health Clinic is a doctor-led clinic where physicians have the autonomy to prescribe what they deem clinically appropriate for their patients. Once a medication has been prescribed, it cannot be altered unless the patient experiences a clinically significant adverse reaction to the Prescribed Medication. In such cases, the patient must provide valid supporting documentation.

Patients who are currently on Methadone, Suboxone, or any Opioid Treatment Program (OTP) medication will not be eligible for prescriptions from Valour Health Clinic.

Patients who are in-eligible for Medicare or Department of Veterans’ Affairs (DVA) funding, may incur an out of pocket fee for consultations and/or prescription.
